Leaseholders’ right to manage


Leaseholders of some blocks of flats can take over management of the building.

To be eligible to manage the lease:

  • the building must contain at least two flats
  • at least half of the leasehold properties in the building must take part
  • at least two thirds of the participating leaseholders must have held their leases for at least 21 years

Some buildings do not qualify – for example those in areas where more than 25% of the buildings are shops.

If you want to claim your right to manage, you must set up a right to manage company. It must use prescribed articles of association. There is a set procedure to follow before you submit your claim. You should take legal advice and guidance.
